Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the wayoverboardsf.com website and your booking of a fishing charter or related service with Way Overboard Sportfishing ("we," "us," or "our"). By booking a trip or using our website, you agree to these Terms.

Bookings & Payment

Trips are booked and paid for through FishingBooker or directly with Capt. Chris. A deposit or full payment may be required to confirm your reservation, depending on the trip type. Pricing is subject to change without notice until a booking is confirmed.

Cancellations & Weather

We reserve the right to cancel or reschedule any trip due to unsafe weather or sea conditions, at the captain's sole discretion, for the safety of all passengers and crew. If we cancel a trip due to weather, we will work with you to reschedule or issue a refund per our cancellation policy. Customer-initiated cancellations are subject to the cancellation terms provided at the time of booking.

Assumption of Risk

Fishing and boating are activities that carry inherent risks, including but not limited to injury from equipment, weather, marine life, and water conditions. By booking a trip, you acknowledge these risks and agree to follow the captain and crew's safety instructions at all times.

Passenger Conduct

All passengers are expected to behave respectfully and follow the captain's instructions. The captain reserves the right to end a trip early, without refund, if a passenger's conduct endangers the safety of others or the vessel.

Age & Supervision

Minors must be accompanied by a parent or guardian. Some trips, such as our shark fishing charters, are adult-oriented and not recommended for children — please contact us in advance with questions about a specific trip's suitability for your group.

Licenses & Regulations

No fishing license is required for saltwater fishing in New Jersey, but anglers must register with the free NJ Saltwater Recreational Registry. Catch limits and size restrictions are set by the State of New Jersey and are subject to change; we will inform you of current regulations at the time of your trip.

The content on this website is provided for general informational purposes. We make reasonable efforts to keep information accurate and up to date but do not guarantee that all content is error-free at all times.

Limitation of Liability

To the fullest extent permitted by law, Way Overboard Sportfishing is not liable for indirect, incidental, or consequential damages arising from your use of our website or participation in a charter, except where such liability cannot be excluded by law.

Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.
